2. The Service

Image Prompt Expert is a software-as-a-service (SaaS) platform that helps users generate and structure image prompts for AI image generation tools.

The Service may include free features, paid features, lifetime access options, and pay-as-you-go credits.

We reserve the right to modify, update, suspend, or discontinue any part of the Service at any time.

3. Accounts

To access certain features, you must create an account.

You are responsible for:

• Maintaining the confidentiality of your account
• All activity that occurs under your account
• Ensuring the information you provide is accurate and up to date

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Lifetime Access

4.1 Meaning of "Lifetime"

"Lifetime" access means access for as long as the current version of the Service is operational and maintained by the Company.

Lifetime access includes:

• Continued use of the current version of the Service
• Ongoing bug fixes and maintenance for that version

Lifetime access does NOT include:

• New major versions of the website or platform
• New features, tools, or services introduced after purchase
• Separate products, premium add-ons, or future platforms

We may, at our discretion, offer upgrades or discounts to lifetime users, but this is not guaranteed.

4.2 Fair Usage Policy (Lifetime)

Lifetime access is subject to fair usage limits.

• Fair usage is defined as up to 1,000 prompts per month
• If usage exceeds this limit, we reserve the right to:
  • Limit prompt generation
  • Throttle usage
  • Enforce the fair usage cap

Fair usage exists to ensure platform stability and fairness for all users.

5. Pay-As-You-Go Credits

Users who purchase credits on a pay-as-you-go basis may use those credits according to the rules shown at purchase.

All pay-as-you-go credit purchases are final and non-refundable.

Unused credits have no cash value and cannot be transferred.

6. Refund Policy

6.1 Lifetime Access Refunds

Lifetime purchases are eligible for a refund only if ALL of the following conditions are met:

• Refund request is made within 30 days of payment
• The account has generated fewer than 100 prompts
• The account is in good standing and not in violation of these Terms

If more than 100 prompts have been generated, no refund will be issued, regardless of time since purchase.

6.2 Pay-As-You-Go Refunds

Pay-as-you-go users are not entitled to refunds under any circumstances.

7. Acceptable Use

You agree not to:

• Abuse, overload, or attempt to circumvent usage limits
• Reverse engineer or copy the Service
• Use the Service for unlawful or harmful purposes
• Attempt to exploit vulnerabilities or misuse the platform

We reserve the right to restrict, suspend, or terminate access for violations.

8. Intellectual Property

All intellectual property rights in the Service, including software, branding, and content, belong to HKA Trading and Marketing Ltd.

You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

9. Availability & No Guarantees

The Service is provided on an "as is" and "as available" basis.

We do not guarantee:

• Uninterrupted availability
• Error-free operation
• Any specific results from generated prompts

10. Limitation of Liability

To the maximum extent permitted by English law:

HKA Trading and Marketing Ltd shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Service.

Our total liability shall not exceed the amount paid by you for the Service in the previous 12 months.

11. Termination

We may suspend or terminate your access:

• If you breach these Terms
• If required by law
• If the Service is discontinued

Upon termination, your right to use the Service ceases immediately.

12. Changes to These Terms

We may update these Terms from time to time.

Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
